Lawful bases and data protection rights

Under UK data protection law, we must have a “lawful basis” for collecting and using your personal information. There is a list of possible lawful bases in the UK GDPR. You can find out more about lawful bases on the ICO’s website.

Which lawful basis we rely on may affect your data protection rights which are set out in brief below. You can find out more about your data protection rights and the exemptions which may apply on the ICO’s website:

If you make a request, we must respond to you without undue delay and in any event within one month.

To make a data protection rights request, please contact us using the contact details at the top of this privacy notice.

Our lawful bases for the collection and use of your data

Our lawful bases for collecting or using personal information to provide services and goods are:

  • Consent - we have permission from you after we gave you all the relevant information. All of your data protection rights may apply, except the right to object. To be clear, you do have the right to withdraw your consent at any time.

  • Contract – we have to collect or use the information so we can enter into or carry out a contract with you. All of your data protection rights may apply except the right to object.

  • Legitimate interests – we’re collecting or using your information because it benefits you, our organisation or someone else, without causing an undue risk of harm to anyone. All of your data protection rights may apply, except the right to portability. Our legitimate interests are:

    • My legitimate interest is to provide a professional SEND consultancy that has multiple services; including delivering specialist SEND and Intersectionality related training to schools, local authorities, families, universities, health and social care and corporate organisations. In addition, I will provide 1:1 SEND staff support to staff working with SEND learners (3-25 years old), create SEND support plans, carry out curricula audits and analysis and provide parent advocacy. By collecting names, contact details, organisation type, health information (including diagnosis), race and ethnicity, religion allows me to effectively manage B2B enquiries, schedule advisory sessions, create bespoke support for the individual and organisation, as well as deliver tailored educational training. The clear benefit of this processing is the improvement of educational and support outcomes for vulnerable children with SEND and upskilling schools and other organisations for supporting vulnerable learners across the multiple identity characteristics (i.e., race, ethnicity, gender). The impact on the individuals involved is minimal, as they are providing standard commercial or professional contact details with a reasonable expectation that their data will be used solely to facilitate the consultancy or training, they have requested. I recognise that intersectional training involving discussions around race, identity, and discrimination can occasionally introduce psychological or emotional risks for participants. To mitigate these risks, all sessions are designed and delivered by a highly specialised consultant holding a PhD in this specific field, ensuring a trauma-informed and empathetic approach. I actively manage participant wellbeing by providing clear options for staff to discreetly exit sessions if needed, offering dedicated debriefing support, and providing professional signposting to external well-being resources. Because I apply strict data minimisation and do not share this data with third parties for marketing, my business operations do not unfairly prioritise my needs over their individual or collective privacy rights.

For more information on our use of legitimate interests as a lawful basis, you can contact us using the contact details set out above.

  • Vital interests – collecting or using the information is needed when someone’s physical or mental health or wellbeing is at urgent or serious risk. This includes an urgent need for life sustaining food, water, clothing or shelter. All of your data protection rights may apply, except the right to object and the right to portability.

Our lawful bases for collecting or using personal information for the operation of customer accounts and guarantees are:

  • Contract – we have to collect or use the information so we can enter into or carry out a contract with you. All of your data protection rights may apply except the right to object.

  • Legitimate interests – we’re collecting or using your information because it benefits you, our organisation or someone else, without causing an undue risk of harm to anyone. All of your data protection rights may apply, except the right to portability. Our legitimate interests are:

    • My legitimate interest is to maintain accurate financial accounts, manage customer billing profiles, and monitor payment history for the services that I provide. This administrative processing is necessary to ensure that invoices are issued correctly to schools, local authorities, families, and all customers, as well as to effectively track outstanding balances. The benefit of this processing is the smooth, sustainable running of my SEND consultancy, which directly enables me to continue delivering vital SEND educational training and support. The impact on the individuals involved is negligible and entirely standard for a professional relationship, as I only process basic business contact and billing names that clients would fully expect me to hold for invoicing purposes.

For more information on our use of legitimate interests as a lawful basis, you can contact us using the contact details set out above.

Our lawful bases for collecting or using personal information for service updates or marketing purposes are:

  • Consent - we have permission from you after we gave you all the relevant information. All of your data protection rights may apply, except the right to object. To be clear, you do have the right to withdraw your consent at any time.

  • Legitimate interests – we’re collecting or using your information because it benefits you, our organisation or someone else, without causing an undue risk of harm to anyone. All of your data protection rights may apply, except the right to portability. Our legitimate interests are:

    • My legitimate interest is to ensure relevant updates regarding my SEND consultancy services, upcoming training courses, and educational workshops are sent directly to professional contacts within schools, local authorities, and healthcare organisations. The benefit of this processing is that it keeps educational institutions and local authorities informed about specialised, intersectional training and services that can improve support outcomes for vulnerable children and young people. The impact on these individuals is very low, as I am contacting them exclusively in their professional capacities using corporate email addresses. Furthermore, I always provide a clear, immediate option to opt out of future communications in every email, ensuring their privacy rights are fully respected.

For more information on our use of legitimate interests as a lawful basis, you can contact us using the contact details set out above.

Our lawful bases for collecting or using personal information for legal requirements are:

  • Legal obligation – we have to collect or use your information so we can comply with the law. All of your data protection rights may apply, except the right to erasure, the right to object and the right to data portability.

  • Vital interests – collecting or using the information is needed when someone’s physical or mental health or wellbeing is at urgent or serious risk. This includes an urgent need for life sustaining food, water, clothing or shelter. All of your data protection rights may apply, except the right to object and the right to portability.

Our lawful bases for collecting or using personal information for dealing with queries, complaints or claims are:

  • Contract – we have to collect or use the information so we can enter into or carry out a contract with you. All of your data protection rights may apply except the right to object.

  • Legitimate interests – we’re collecting or using your information because it benefits you, our organisation or someone else, without causing an undue risk of harm to anyone. All of your data protection rights may apply, except the right to portability. Our legitimate interests are:

    • My legitimate interest is to thoroughly investigate, respond to, and resolve any customer queries, complaints, or formal legal and insurance claims arising from the services (e.g. training, SEND staff support) delivered through my SEND consultancy. The benefit of this processing is that it allows me to maintain high professional standards, protect my business infrastructure, and ensure fair dispute resolution for schools, local authorities, and families. The impact on the individuals involved is minimal and entirely proportionate, as they would reasonably expect their correspondence and relevant service logs to be reviewed and preserved in order to address their specific grievance or to manage an active legal claim.

For more information on our use of legitimate interests as a lawful basis, you can contact us using the contact details set out above.
